This website is operated by Diamond Cardboard, LLC (“Diamond Cardboard,” “we,” “us”). These terms apply to everyone who uses the site, and to every purchase. By using the site or placing an order, you agree to them, along with our Shipping & Returns and Privacy Policy, which are part of these terms. If you don't agree, please don't use the site.
◆1. Using the site
- You must be at least 18 years old, or have a parent or guardian's permission, to buy from us.
- You may not use the site for anything illegal, or try to disrupt, hack or overload it.
- We may suspend or end access for anyone who breaks these terms.
◆2. General conditions
- We may refuse service to anyone, for any reason, at any time.
- Payments are handled by PayPal over encrypted connections. We never receive or store your card number.
- The site's content, including card photos and descriptions, belongs to Diamond Cardboard. You may not copy, reproduce or resell it without our written permission.
◆3. Information on this site
We work hard to describe every card accurately, but the site may occasionally contain errors, omissions or out-of-date information. Information on the site is provided for general purposes, and you rely on it at your own risk. We may correct errors or update information at any time without notice.
◆4. Prices and changes
- Prices are in U.S. dollars and may change at any time without notice.
- Prices on this site may differ from prices for the same card on eBay or elsewhere.
- We may change or discontinue any part of the site at any time, and we aren't liable for doing so.
◆5. The cards we sell
- Every card is a single, one-of-a-kind item, and the photos on each listing show the actual card you'll receive, front and back. Please review them carefully before buying. Colors may look slightly different depending on your screen.
- Graded cards were graded and encapsulated by independent third-party grading companies (such as PSA, SGC, BGS or CGC). Grades and authentication decisions are those companies' opinions, made under their own standards. We don't control them and don't guarantee that another company, or a resubmission, would reach the same result.
- Ungraded (raw) cards are described using our own judgment of condition. That is an opinion, not a grade or a guarantee of how a grading company would grade the card.
- We may limit the quantity of cards sold to any person, household or order.
◆6. Orders and availability
- Your order is accepted only when payment completes and you receive an order number.
- Our cards are also listed on eBay, so a card can occasionally sell there at almost the same moment you check out. We check availability right before your payment is taken. If a card is no longer available, you won't be charged for it. If a card sells in two places at once after payment, we'll tell you right away and refund you in full.
- We may refuse or cancel any order, including after it has been placed, for example because of a pricing or listing error, a problem with payment, or suspected fraud. If we cancel an order you paid for, we refund you in full.
- You agree to give us current, complete and accurate contact and shipping information.
◆7. Payment and tax
Payment is through PayPal: your PayPal account, or a debit or credit card through PayPal. Pennsylvania shipping addresses are charged Pennsylvania sales tax on the cards (not on shipping), as shown at checkout. You choose your shipping address in PayPal, and we ship to the address on your PayPal payment.
◆8. Offers
- On cards marked “Make an Offer,” signed-in customers may offer a price below the listed price. Offers exclude shipping and sales tax. We may accept, decline or counter any offer, and some offers are answered automatically.
- An accepted offer locks in your price for 24 hours, but doesn't reserve the card. The card stays for sale on this site and on eBay until someone pays for it. If it sells before you check out, your offer closes and you aren't charged. After 24 hours, an unpaid accepted price ends.
- Offers we haven't answered within 24 hours expire, as do counter-offers you haven't answered within 24 hours. We may limit how many offers a customer can make.
◆9. Shipping, returns and refunds
Shipping rates, insurance, processing times and our return policy are on our Shipping & Returns page, which is part of these terms. In short: we don't accept returns on graded or authenticated cards without just cause, and if something is wrong with your order (including a package lost or damaged in transit), contact us within 3 days of delivery. Approved refunds go back to your original payment method through PayPal.
◆10. Errors and corrections
The site may contain typographical errors, inaccuracies or omissions in descriptions, prices, availability or shipping details. We may correct them, and change or cancel orders affected by them, at any time, including after you've placed your order. We're not obligated to update information except as required by law.
◆11. Third-party services
The site relies on services run by other companies, such as PayPal (payments and shipping labels), postal carriers and eBay, and may link to other websites. Those services have their own terms, and we aren't responsible for their content, policies or actions.
◆12. Your personal information
How we collect and use personal information is explained in our Privacy Policy.
◆13. Your account
If you create an account, you're responsible for keeping your password private and for activity under your account. Let us know right away if you think someone else has used it.
◆14. No warranties
ALL CARDS ARE SOLD “AS IS.” TO THE FULLEST EXTENT PERMITTED BY LAW, DIAMOND CARDBOARD MAKES NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, AND NO WARRANTY AS TO A CARD'S AUTHENTICITY, GRADE, CONDITION OR FUTURE VALUE, BEYOND THE DESCRIPTION AND PHOTOS IN ITS LISTING.
The site itself is provided “as is” and “as available.” We don't promise it will always be uninterrupted, secure or error-free.
◆15. Limitation of liability
To the fullest extent permitted by law, Diamond Cardboard and its owners, employees and service providers aren't liable for any indirect, incidental, special, punitive or consequential damages, including lost profits or changes in a card's market value, arising from your use of the site or any purchase. Our total liability for any claim related to an order is limited to the amount you paid for that order.
◆16. Indemnification
You agree to defend and hold Diamond Cardboard harmless from any third-party claims, including reasonable attorneys' fees, arising from your breach of these terms or your violation of any law or the rights of others.
◆17. Disputes and chargebacks
Please contact us before opening a PayPal dispute or chargeback. Nearly every problem can be solved faster by email, and we'll work with you in good faith.
◆18. Severability and waiver
If any part of these terms is found unenforceable, the rest still applies. Our not enforcing a right or term doesn't waive it.
◆19. Termination
These terms apply until ended by you or us. You may stop using the site at any time. We may end your access if you break these terms. Obligations that arose before that, such as payment for orders, continue.
◆20. Entire agreement
These terms, together with the policies they refer to, are the entire agreement between you and Diamond Cardboard about the site and your purchases, and replace any earlier communications on those subjects.
◆21. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania. Any dispute that we can't resolve together will be handled in the state or federal courts serving Centre County, Pennsylvania.
◆22. Changes to these terms
We may update these terms by posting a new version here. The version posted when you place an order applies to that order. Continuing to use the site after a change means you accept the updated terms.
