Welcome to Diamond Cardboard's Set Breaks! Before participating in our set breaks, please review the following important information. We aim to ensure full transparency and legal compliance, and your participation confirms your understanding and acceptance of these terms.
1. Eligibility Requirements
To participate in any set break organized by Diamond Cardboard, all participants must meet the following eligibility criteria:
Age Requirement: You must be 18 years of age or older to participate in any set break. By purchasing a spot, you confirm that you meet this requirement.
Residency Requirement: Participation is limited to individuals who reside in the United States. Only U.S. residents are eligible to join and receive cards from set breaks.
Shipping Address: All participants must provide a valid mailing address within the United States.
By participating, you confirm that you meet these eligibility requirements.
2. This is NOT a Raffle or Gambling Event
Our set breaks differ from traditional raffles in that everyone wins. When you purchase a spot in a set break, you are guaranteed to receive a card corresponding to that spot after the randomization has occurred. While some cards may have higher value than others, every participant will receive a card, ensuring no one leaves empty-handed.
3. Transparency in Card Distribution
The distribution of cards is conducted fairly and randomly. We make it clear in advance that the value of cards can vary. By participating, you acknowledge that each spot entitles you to a randomly assigned card of varying value.
4. Livestreaming and Video Recording
To ensure complete transparency and fairness, all of Diamond Cardboard's set breaks are conducted live. Our breaks are streamed on platforms such as YouTube Live, Facebook Live, or other video services so that participants can watch the process in real-time. For those who cannot attend the livestream, we record every set break and make the video available for review. This ensures that all participants can verify the randomization process, the cards pulled, and the spot assignments. During the livestream, the randomization of participants and cards is conducted using a trusted tool like Random.org. The entire process is displayed live so you can follow along and verify the results.By participating in the break, you acknowledge that the set break will be livestreamed and recorded, and that these recordings may be shared with the community.
5. Participation and Fairness
Spots are offered on a first-come, first-served basis, ensuring that the first participant to select and pay for a spot secures it. This eliminates the possibility of multiple participants claiming the same spot simultaneously. If payment is not made within 48 hours of spot approval by Diamond Cardboard, the spot will be forfeited and made available to others.
6. No Refund Policy
All sales are final. Due to the nature of set breaks, we cannot offer refunds once your spot is confirmed. If a break is canceled for any reason, participants will receive a full refund.
7. Shipping and Insurance
All cards will be securely packaged and shipped with insurance within 5 business days after the break concludes. We take every measure to ensure your cards arrive safely. Tracking information will be provided once your package is shipped. All packages are shipped, fully insured, through USPS or FedEx. However, shipping times may vary depending on your location and the carrier’s service levels. We cannot guarantee exact delivery times, but we will do our best to ensure timely shipments.
8. Legal Considerations in Pennsylvania
Set breaks involve an exchange of money for a product and are structured to ensure they do not fall under Pennsylvania’s gambling or raffle laws. Since each participant receives a card, this is considered a sale of goods rather than a game of chance. If you have any questions, feel free to contact us for clarification.
9. Tax and Sales Information
We comply with all applicable tax laws in Pennsylvania. Depending on your location and the value of your purchase, sales tax may be applicable. Please ensure you understand your tax obligations based on your location.
10. Waiting List and Reassignment of Forfeited Spots
Diamond Cardboard maintains a fair and organized system for handling any spots that become available due to forfeiture or non-payment.
Forfeited Spots: If a participant fails to pay for their spot within the designated 48-hour payment window, their spot may be forfeited and made available to other participants.
Waiting List: In the event of a fully booked set break, we will create a waiting list for participants interested in claiming any forfeited spots. Spots will be reassigned to individuals on the waiting list based on the order they joined the list.
Reassignment Process: If you’re on the waiting list, you will be contacted directly via email if a spot becomes available. You will have 24 hours to confirm your interest and submit payment to secure the forfeited spot.
Intellectual Property and Ownership
The Google Sheet used for our set break process, including its structure, format, and any related systems or procedures, is the exclusive property of Diamond Cardboard LLC. All content, designs, processes, and materials associated with this set break, whether digital or physical, are protected by intellectual property laws.
By participating in our set breaks, you agree that you will not copy, modify, distribute, or otherwise use any aspect of our proprietary processes or materials without express written permission from Diamond Cardboard LLC.
Copyright and Trademark Notice: All materials used in connection with our set breaks, including but not limited to the Google Sheet, logos, text, graphics, videos, and livestreams, are protected by copyright, trademark, and other intellectual property laws. Unauthorized use, reproduction, or distribution of these materials is strictly prohibited.
Diamond Cardboard reserves the right to take appropriate legal action against any individual or entity that infringes on our intellectual property rights.
